Hi everyone,

I recently ordered some wood floor and got a wrong delivery. It was a vety similar floor thought, the was almost the same and they look very much the same. So it took me some day to realise the mistake. But then by the tine I realized, i had opened several packages, cut many of the boards and so on.

Now my question is: what can I demand from the dealer. Does he need to accept to either give metme correct floor without extra cost or give me the money back?

Unless you can make som agreement - accept the delivery maybe with a discount or the seller proves very friendly, then this can probably not be solved without a specialist appraising the the issue - making a judgement of the importance of the difference - and your possibility of checking before cutting. That will often cost a lot and end in court - so negotiate a solution - after all you cut several boards - so it must be something very close to the order - and you thereby somehow accepted it -will not doubt be an argument

Hi John,

Thank you for the very fast answer.

Yes indeed the product is very similar. But the installation method is very different. The floor I got need to be glued together. The one we ordered does not and it has some wider boards. Meaning. I need to take out everything I made (a whole day work) and put it back together using glue (much more difficult and long process) and on top of it, there will be not enough floor since the one I got is smaller.

And the company refuse to take responsibility. I spoke with them on the phone and they admitted that there was a mistake way before when they ordered the product from the factory. But still they want me to pay for the boxes I already open.

I just refuse to accept it or the accept any other solutions if not getting the write order.

Do you have any other tip on how to proceed from now. Is the next step contacting s lawyer and if yes could you recommend some firm.

yes - next is to contact a lawyer - and I do not know one specialist in that area - Bare in mind, it will easily cost 20.000 by the end of the day through court - as you will probably not just winn this as a clear victory so I would negotiate all I could and compromise - it is possible a court will say he must take back the opened boxes of NOT cut board - but the things you have worked on, I am pretty sure it will say is on you AND your work - made not detecting you had the wrong flor - will quite likely be on you as well - but everything is possible here

It is your responsibility to check that what you have accepted is correct, before you start assembly and mounting.

You should be able to check labels on the product beforehand and you have only limited time to check. Leaving it several days, before checking is not widely accepted.

Now, the company/seller has to accept that you return the wrong product, but you will end up paying for what you have already cut and assembled. That is not the responsibility of seller, unless you have no markings/labels on the product and therefore unable to control.

Please observe: First time with lawyer and he sends a letter to Seller: DKK 5,000.-

You're better off accepting your fault and pay for what you cut.

Take my advice. Only lawyers will win, if you proceed.
