Brand Kræver Jeg Lukker Mit Site - Juridisk Råd?

Jeg har bygget på http://www.Inov8Shoes.org de sidste 3 måneder, og det er ved at sætte sig pænt i Google top 10. Desværre fik jeg forleden denne korrespondance:

Although I am both honored and appreciative of your support of inov-8, inc., as the General Manager and Product Manager of the US business, I cannot allow this site to continue operating.

There are inconsistencies, misspellings and associations that I'd prefer you not make in this site.

Again, I appreciate your support of inov-8 product, but there are other ways to show your support.

Please confirm receipt of this message and removal of the site, or lawyers will need to step in.

I am the owner and operator of Inov8Shoes.org and I thank you for taking contact to me. I am the proud owner of the Inov8 230 which I use exclusively for CrossFit.

I'm really sorry to hear that you wish my fan site terminated, as I've spent a lot of work on it and honestly like to promote the Inov8 product line.

Is there any way in which I can correct the inconsistencies and bring my support site back to standards that you would be proud of being associated with? I really enjoy the work I put into Inov8Shoes.org and will do anything required to continue the site.

I hope we can come to an arrangement so that I can continue my support of Inov8 with my website.

Sorry, Nick, there are legal reasons beyond inconsistencies. You'd be better off creating a minimal footwear or CrossFit blog that comes across as SOLELY a blog.

Jeg kan selvfølgelig godt se (og vidste det lidt på forhånd) at jeg var på dybt vand ved at bruge deres navn i domænenavnet. Spørgsmålet er, kan jeg ændre domænenavn eller andet for at beholde sitet? Ellers må jeg jo bare lukke det.

Ja det er ikke super smart ....

Jeg har lige suspenderet hostingkontoen, så I kan desværre ikke se websitet mere.

Hvis den skal være clean - så vil det som udgangspunkt kræve at du:

- Får et nyt navn

- Fjerner alle copyright billeder

- Hvis du har tekster der direkte er stødende skal de cleanes (dette så jeg ikke om der var).

Derefter kan du først republishere sitet :-)

Lidt fluekneb ... deres brand er Inov-8 ... er det så galt at skriv om Inov8 på hjemmesiden? Arh det ser sgu ikke helt brandsikkert ud...

Nej det er der ikke som udgangspunkt.

Men man kan sige det du har gjort er at kalde din forretning/site for et brand. Fx hvis du kalder dit site PUMA, så udgiver du dig eksempelvis for at være puma..

Men det du kan gøre er at du tager journalist rollen, fx som TV2, du har et site - med diverse indhold, og så anmelder eller skriver du om et produkt fra en tilfældig leverandør.

Det kan de ikke forbyde dig - medmindre det er direkte forkert/stødende, så kan de formenligt prøve den af i en retsal :-)
