There currently isn't a position within the organisation as they are yet to define the role and type of position they plan on hiring. Until then they have offered me a consultancy role over a 3 month period while the company defines the role for the new positio. They hope to have this in place by then end of the 3 month contract.

There is nothing wrong with starting a consultancy with one customer. The danger here as John points out is that for it to certainly (discression/judgement of Skat employee) be considered a company by Skat, then you have to be able to PROVE that it is not a defacto employment. If you ex. offered your services on Guru.com, Worksome, People by the hour, Amino.... ie platform work, you should be safe.

Make a web page, Facebook/Linkedin and maybe buy 500kr AdWords to promote your particular abilities and then you will be safe.

The thing is - make the story work!

It does not matter if it is a current position or not - it is a question of all the criterias deciding between employe og independent - Often it might be a good idea to get a binding answer from TAX if there is any doubt. More than 100% tax in a LTD / ApS would not be nice

det er klart farligt, hvis arbejdet reelt er lønmodtagerarbejde (du skriver stilling) at gøre noget som helst andet end blive ansat. Det vil kunne give skat og bod over 100% af lønnen + skat af momsen også og mistet momsfradrag. Farligst er det i ApS form men også enkeltmands vil miste momsfradrag og få skat af momsen + arbejdsgiver miste momsfradrag og få bod https://johnhannover.blogspot.com/2018/09/lnmodtager-eller-fakturere-som.html Da ganske mange arbejdsgivere kan finde på at kræve CVR og ansatte ville sende regning for at undgå topskat - er det et område skat har udmeldt fokus på

Topskat kan undgås ved f.eks ratepension og livrente indbetalinger

Hej,

Jeg er interesseret i at høre, hvilken type virksomhed (ApS eller enkeltmandsvirksomhed) jeg skal starte ud fra følgende?

Jeg har fået tilbudt muligheden for at indgå en freelance kontrakt i 3 måneder hvilket sandsynligvis vil føre til en fuldtidsstilling hos det samme firma.

Hvilken virksomhedstype ville give mig den bedste indkomst efter skat baseret på følgende eksempel?

Hvis jeg tjener 500.000kr på 3 måneder i min virksomhed og derefter får et fuldtidsstilling med en årsløn på 600.000kr. Hvad ville den bedste løsning være til reducere mine skattebetalinger?

1. Hvis jeg opretter en eneforhandlervirksomhed, vil jeg sandsynligvis overstige topskat-niveauet (531.000kr i 2020)

2. Hvis jeg opretter en ApS, vil jeg være i stand til at reducere min indkomst og betale mig selv og min kone udbytte. men en ApS har ekstra omkostninger til at starte og lukke virksomheden og jeg vil sandsynligvis har brug for en revisor og at finde en opstartskapital på 50.000kr til start ApS som jeg ikke har i øjeblikket.

Hvad ville være smartest?
